Terms of Use Agreement

Please read these Terms of Service ("Terms") carefully before using the Auro Presence website or placing an order.

1. ACCEPTANCE OF TERMS

By accessing, browsing, or purchasing from Auro Presence ("Auro Presence," "we," "our," or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms, together with any policies referenced within them, including our Privacy Policy, Shipping Policy, and Refund Policy. If you do not agree with these Terms, please discontinue use of our website and services.

These Terms govern your access to and use of our Shopify-powered website, including all pages, content, features, products, communications, and services made available through it (collectively, the "Services"). By continuing to use our Services, you agree that these Terms form a legally binding agreement between you and Auro Presence.

As our business evolves, we may update these Terms from time to time to reflect changes in our products, services, legal obligations, or business practices. When we do, we will update the "Last Updated" date at the top of this page. Any changes become effective immediately upon publication unless otherwise required by applicable law.

Your continued use of our website or Services after revised Terms are posted constitutes your acceptance of those changes. We encourage you to review these Terms periodically to stay informed of any updates.

To use our services or place orders through Auro Presence, you must:

Be at least eighteen (18) years of age, or the legal age of majority in your jurisdiction.
Possess the legal capacity to enter into binding contracts under Philippine laws.
Provide true, accurate, current, and complete personal and payment information as prompted during checkout.

If you are under 18, you may use our store only under the supervision and consent of a parent or legal guardian who
agrees to be bound by these Terms.

Auro Presence specializes in curating artisanal, luxury, and fine perfume products. All products are offered subject to availability.

Stock Availability: We strive to maintain accurate inventory figures on our store. However, due to high demand or
handcrafted batch limits, items may become unavailable. We reserve the right to limit the sales quantity of our
products to any individual, household, or geographic region.
Batch & Formulation Variations: Perfumes are composed of natural, aromatic ingredients, and fine botanical
extracts. Subtle variations in scent hue, intensity, or maceration tone between manufacturing batches are natural
characteristics of artisanal perfumery and do not constitute a product defect.

All prices listed on Auro Presence are in Philippine Pesos (PHP) and are inclusive of applicable Philippine Value-Added Tax (VAT), unless stated otherwise.

Price Adjustments: We reserve the right to modify pricing, promotional rates, and delivery charges at any time
without prior notice. Price changes will not affect orders that have already been confirmed and accepted.
Pricing Errors: In the rare event that a product is listed at an incorrect price due to technical error, we reserve the
right to cancel or decline any orders placed for that item, providing a full refund if payment was already processed.

Placing an order constitutes an offer to purchase our products. Upon receiving your order, our store will generate an
automated confirmation email acknowledging receipt.

Note on Contract Formation: An order confirmation email does NOT signify our official acceptance of your order. A binding sales contract is formed only when your order has been verified, packed, and assigned a shipping tracking
number.

We reserve the right to refuse, limit, or cancel any order for reasons including, but not limited to: suspected fraudulent
activity, unauthorized resale, unavailability of stock, incorrect delivery addresses, or breaches of these Terms.

We support secure, convenient local payment options processed through encrypted third-party payment gateways integrated into our Shopify store. Accepted payment methods include:

E-Wallets: GCash, Maya, ShopeePay
Credit / Debit Cards: Visa, Mastercard, JCB

You authorize us and our payment processors to charge your selected payment method for the total amount of your order.

Auro Presence operates exclusively within the Republic of the Philippines.

Coverage: We ship to major Metro Manila locations, Luzon, Visayas, and Mindanao via our authorized courier
partners (J&T Express).
Processing & Delivery Timelines: Orders are processed within [1-3 business days] . Standard transit times are:
Metro Manila: 1-2 days
Provincial Areas: 2-3 days
Delivery Addresses: Customers are responsible for providing complete and accurate shipping details (including barangay, landmarks, and active mobile number). We are not responsible for delays or non-deliveries resulting from inaccurate customer address information.

All items purchased from The Auro Presence are made pursuant to a shipment contract. Title to the products passes to you upon delivery to your designated address. Risk of loss or damage to products transfers to you upon actual delivery by our logistics provider. In the event of lost packages in transit, we will assist you in liaising with our third-party courier for investigation and resolution.

Due to health, hygiene, and product integrity standards surrounding personal care and fragrance products, all sales are generally final. However, in compliance with Philippine Consumer Law (RA 7394) and our commitment to customer satisfaction, we evaluate return/refund requests on a strict case-by-case basis.
Qualifying Criteria for Returns/Exchanges:

Damaged / Broken Bottling: Products received with cracked glass, leaking atomizers, or broken caps upon
arrival.
Incorrect Item Sent: Received a different fragrance or volume size from what was ordered.
Defective Atomizer: Mechanical failure of the spray mechanism upon first use.

We aim to accurately describe our fragrance notes (Top, Heart, Base), longevity, and olfactory profiles.

Individual Skin Chemistry Notice: Perfume notes interact dynamically with individual skin chemistry, pH levels, moisture, diet, and climate. Fragrance performance, dry-down notes, and longevity may vary from person to person. Descriptions on our site serve as sensory guidance and do not guarantee an identical experience.
Patch Testing & Sensitivity: Fragrance compounds contain essential oils and aroma molecules. Customers are advised to review ingredients and perform a small patch test before full application. Stop use immediately if irritation or allergic reaction occurs.

If you create an account on our store, you are responsible for maintaining the confidentiality of your login credentials and for restricting access to your computer or mobile device. You agree to accept full responsibility for all activities that occur under your account.

All content on this website—including but not limited to brand names, logos, trade dress, perfume formulation names, product descriptions, website graphics, images, video clips, and code—is the exclusive property of The Auro Presence and protected under Philippine IP laws (Republic Act No. 8293) and international copyright treaties. Unauthorized reproduction, copying, or redistribution is strictly prohibited.

When you submit reviews, photos, comments, or feedback on our platform or tagged social channels, you grant The Auro Presence a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, publish, and display such content in marketing material. Reviews must be honest, respectful, and free from obscene or defamatory language.

Promotional codes, discounts, and introductory offers are subject to specific terms announced during the campaign. Unless expressly stated, discount codes cannot be combined, applied retroactively to previous orders, or redeemed for cash.

You are prohibited from using the store or its content: (a) for any unlawful purpose; (b) to solicit others to perform illegal acts; (c) to violate any Philippine national or local regulations; (d) to infringe upon our intellectual property rights; (e) to upload malicious code, viruses, or scrapers; or (f) to engage in fraudulent resale or unauthorized commercial distribution of our products.

Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform. Certain third-party plugins, shipping providers, and payment processors have their own privacy and operational policies. We encourage you to review their terms. We are not liable for third-party tools or service interruptions outside our direct control.

Your privacy is important to us. Our collection, use, and disclosure of personal information are governed strictly in
compliance with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173) and our Privacy Policy. By using our
store, you consent to the processing of your data as outlined in our Privacy Policy.

Our products and store services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted under Philippine law.

To the fullest extent permitted by law, The Auro Presence, its directors, officers, employees, and suppliers shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of our products or website. Our maximum aggregate liability for any claim shall not exceed the total amount paid by you for the specific product in dispute.

You agree to defend, indemnify, and hold harmless The Auro Presence, its officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your violation of these Terms or your misuse of our products or platform.

The Auro Presence shall not be held liable or responsible for any failure to perform, or delay in performance of, any of our obligations caused by events outside our reasonable control ("Force Majeure Event"), including natural disasters (typhoons, earthquakes), courier disruptions, government restrictions, customs delays, or network failures.

We reserve the right to suspend or terminate your account or block access to our store immediately, without prior notice, if you breach these Terms, engage in fraudulent transactions, or demonstrate abusive behavior toward our staff or community.

These Terms and any separate agreements shall be governed by and construed in accordance with the laws of the Republic of the Philippines, including the Consumer Act of the Philippines (RA 7394), the Electronic Commerce Act (RA 8792), and the Data Privacy Act (RA 10173).

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or your purchase, both parties
agree to first attempt to resolve the issue amicably through good-faith negotiation by contacting customer support. If unresolved within thirty (30) days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts in Mandaluyong City, Philippines.

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall remain enforceable to the fullest extent permitted by law, and the remaining portions shall remain in full force and effect.

We reserve the right to update or modify these Terms at any time. Any changes will be posted directly on this page with an updated "Last Updated" date. Continued use of our store after changes are published constitutes acceptance of the modified Terms.
